Way Out From Hi-Tech Marketing Lawsuit (Fhtm)



If you recall, it wasn't too long ago that Fortune Hi-Tech Marketing (FHTM) was issued a cease and desist order as well as its principals, Paul Oberson, Jeff Oberson, and Thomas Mills for violations of North Dakota transient merchant consumer fraud and home solicitation sales laws. This occurred December 10, 2009.


The problem was that FHTM failed to get a license that is required by the state. This doesn't sound like a big problem but this one violation opened the door to more scrutiny. There seemingly were more accusations as to the possibility of whether the company was violating the pyramid law in North Dakota. North Dakota prohibits promotional pyramid schemes in which the participant pays for the opportunity to receive income primarily from the recruitment of other participants rather than the sales of products and services.


But, this matter appeared to be a minor thing and quickly cleared up or it appeared to have cleared up.


On the Kentucky.com web site, there was a report on March 16th, 2010 that the state of Montana, after a five month investigation found Fortune Hi-Tech Marketing to be an illegal pyramid scheme.


Due to its violation, FHTM has been banned from the state of Montana. The company is prohibited from doing business there.


Fortune Hi-Tech has many thousands of representatives in the U.S, Canada, and Great Britain. In order to become a representative with Fortune, one has to pay 9.00, then sell products and services in health & beauty, services; such as GE Home Security, AT&T, Sprint, and Nextel, entertainment; such as, dish network, etc, and communications like their wireless shop, voice connect, and more.








The person at the top of the pyramid receives commissions from each sale and each new membership, which is considered to be legal because they sell products. This is Fortune's side of the story. On the other hand, Montana disagrees.


Montana feels that FTHM is not a multi-level distribution company, but rather a pyramid company because the compensation each participant in the program receives is derived primarily from obtaining the participation of other persons in the program and not the sale of goods and services. Hence, the cease and desist order.
